The Legal\nmetrology Act \u2013 Today we are discussing about this Act.  This was introduced in 2009 and came into\nforce from 1st<\/sup> April 2011 to replace the Weights & Measures Act\nof 1976. The main agenda of the Act was to enforce the standards of Weight\n& Measures and to regulate Trade & Business with respect to the Goods\nsold or distributed by weight, measure, or number.<\/p>\n\n\n\n

The Legal\nMetrology (Packaged Commodity) rules 2011 pertains to all goods which are\npacked. The rules provide the declaration to be made for packaged commodities.\nThe Act applies in measure to:<\/p>\n\n\n\n

  1. Packers \u2013 Person or business which\nprepacks a commodity in bottle, wrapper, box, tin or otherwise in suitable\nunits of sales, either wholesale or retail.<\/li>
  2. Manufacturers \u2013 Manufacturing\nweights or measures, one or more parts required to manufacture weights or\nmeasure or assembling of products at the end which will be called as weights or\nmeasures either with their own mark or otherwise.<\/li>
  3. Dealer \u2013 Person dealing in goods in\nrelation to weights or measures, business of buying, selling, supplying, or\ndistributing products for weights or measures either for cash or deferred\npayment or commission or any other valuable consideration.  It also includes commission agents,\nmanufacturers and importers dealing in weights or measures.<\/li>
  4. Importer \u2013 The Individual Firm or\nany legal entity\/company that imports goods from a foreign country.<\/li>
  5. Repairer \u2013 The business which\nundertakes repairs of weights or measures including a person who adjusts,\ncleans, lubricates, or paints any weight or measure equipment or render service\nto ensure such weight or measures conform to the standard of the Act.<\/li><\/ol>\n\n\n\n

    All the\nabove categories are required to register under the said Act by filling\nrequisite application and pay fees as per regulation 27 of the rule.<\/p>\n\n\n\n

    Further, a\nmandatory declaration needs to be made under the Act Regulation 6 of the rules.<\/p>\n\n\n\n

    The rules\nmandate declaration on every package intended to be commercialized.  The declaration should contain details as\nbelow.<\/p>\n\n\n\n

    1. Name & Address<\/li>
    2. Common or Generic name of the\ncommodity<\/li>
    3. Net quantity in terms of unit of\nmeasurement of the commodity<\/li>
    4. Manufactured or prepacked or\nimported <\/li>
    5. Month and year of the commodity.<\/li>
    6. Retail\nSale price<\/li>
    7. Size and dimension<\/li>
    8. Penalties<\/li><\/ol>\n\n\n\n

      Manufacturing of nonstandard weight or measure\nwill attract penalty up to Rs 25,000\/- and subsequent offences may be with\nimprisonment for the term extended with fine or both.<\/p>\n\n\n\n

      If there is an error in the net quantity of\ndeclaration in pre-packaged or importing commodity, the fine will not be less\nthan Rs 10,000\/- which may extend to Rs 1 lakh or imprisonment of 1 year or\nboth.<\/p>\n\n\n\n

      Regulation 32 imposes penalty on the\nnon-registered.<\/p>\n\n\n\n

      The offences can be compounded either before or\nafter institution of prosecution on payment of prescribed sum, however,\ncompounding is not allowed if the same or similar offence is committed earlier,\nwithin 3 years of the first offence.<\/p>\n\n\n\n

      Offences by companies:  Companies are required to nominate a person\nwho will be held responsible for the conduct of the company communication and\nlegal metrology. If no person is nominated, then the person in charge of the\noperation shall be responsible. The company may be directed to publish the\noffence in newspaper at their own cost.<\/p>\n\n\n\n

      Appeals are allowed to be filed with higher\nauthority within 60 days of the order.<\/p>\n","protected":false},"excerpt":{"rendered":"
